The following legal notice (from now on, the “legal notice”) regulates the use of the Getxo Empresarial y Comercial’s (GEYC) web http://www.getxoempresarialycomercial.com (from now on the “web”). Legislation

Generally the relations between GEYC and Users of the web’s services are regulated by the Spanish legislation and jurisdiction. The Parties, expressly waiving the Basque traditionnal law that may correspond to them, submit themselves to the jurisdiction of the Courts and Tribunals of Biscay for any interpretation disagreement or for the implementation of the present conditions.

Content and use

This website and its use don’t imply any commercial relation with GEYC.

The Web’s holder doesn’t take responsibility for its collaborators opinions. GEYC reserves the right of making modifications without prior warning by changing, suppressing or adding contents and services and the appearance or localization of them.

Intellectual and industrial property

Intellectual property rights of the web’s contents, its graphic design and source code belong to GEYC. Therefore, its reproduction, distribution, public communication, transformation or any other activity that could be done with the web page’s contents is strictly forbidden. This forbid applies even with a quotation related to the sources except with GEYC’s consent. All the commercial names, marks or distinction signs of the GEYC web’s contents belong to its owners and are protected by law.

The presence of links in the GEYC web page has only an informative purpose. It does not mean any suggestion, invitation or recommendation of the mentioned links.

Confidentiality and data protection

In compliance to that which is set forth in the Protection of Personal Data 15/1999 Organic Law (13th December), GEYC notifies the users of the existence of a personal data automated file created for and by GEYC and under its responsibility. The objective is maintaining and managing the relationship with users and informing them. Users give their consent to the inclusion of their data in the automated file and to the reception of information about GEYC products. At the time of the general conditions’ acceptance, GEYC will need some essential details from the User in order to render the services.

Files and forms record

The registry form fulfil is compulsory in order to enter and use the services given by the Web. Not giving the required personal data or not accepting the data protection policy described mean the impossibility of subscription, registration or participation in any of the promotion in which personal data are required.

In accordance with the Personal Data Protection 15/1999 Organic Law (13th September), GEYC inform you that the personal data obtained during the registry, are incorporated to a file belonging to GEYC (c/ Arene, 22. 48991 Getxo-Biscay) which follows the security measures established in the 994/1999 Royal Decree (11th June).

Accuracy and veracity of the provided data

Users are responsible for the accuracy and veracity of the given data and GEYC has no responsibility in this area. Users guarantee and answer the accuracy, validity and veracity of the given personal data, and compromise themselves to have them updated. Users accept giving complete and correct information while filling the registration or subscription form. GEYC is not responsible for the veracity of information given by the users or for the damages that could be done by the use of this information. GEYC reserves the right to update, modify o delete information contained in its web pages, even when it limits or denies the access to information. GEYC is exonerated for its responsibility for any possible damage that users could suffer due to errors, defects or omissions in the information given by GEYC when this information comes from others than GEYC.

The finality of the GEYC is maintaining and managing the relationship with users and informing them.

Minors

In case that minors would be targeted by GEYC services, GEYC would request the parents’ or tutors’ consent in order to collect personal data or to treat their personal data.

GEYC doesn’t transfer users’ data to third parties.

Free exercise of the right of access, rectification, cancelation and opposition

Users can decide over sending their communications and exercising their right of access, rectification, cancelation and opposition of their data either in the following Internet address: info@getxoempresarialycomercial.com or by ordinary mail: GEYC, Ref. LOPD, c/ Arene, 22. 48991 Getxo-Biscay. In order to exercise the mentioned rights and in accordance of the Protection Data Agency’s 1/1998 Instruction (19th January), the accreditation of the user´s identity at the GEYC is needed either by sending an ID photocopy or any other media recognise by Law. Nevertheless, the modification or rectification of Users’ registry data can be done through the website after logging in.

Security measures

GEYC has adopted the security levels of Personal Data protection legally required. GEYC also tries to install those additional media and technical measures in order to prevent losing, misusing, alteration, unauthorised access or robbery of the personal data given to GEYC. GEYC is not responsible for eventual damages that could arise from interferences, omissions, interruptions, informatics virus, telephonic breakdowns, o disconnections of the electronic system caused by external causes. GEYC is exonerated for its responsibility for delays or electronic blackouts caused by telephone lines deficiencies or overloads or by overloads at the Data Process Centre, in Internet or in other electronic systems. It is also not responsible for damages by third parties caused by illegitimated access.

Nevertheless, users should be aware that Internet security measures are not infallible.

Acceptance and consent

User declares to have been informed of the personal data protection, accepting and consenting the automated treatment of these data by GEYC in the form and for the finalities indicated in the present Personal Data Protection Policy. Certain services given on the web page can contain particular conditions with specific previsions in Personal Data protection.
